Agreement to Terms
Welcome to PineFixers. By accessing or using our HVAC marketplace platform at https://pinefixers.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our platform.
Legal Entity
PineFixers is a service provided and operated by IT Morph LLC, a limited liability company. These Terms of Service are entered into between you and IT Morph LLC as the legal entity operating the PineFixers platform.
Legal Entity: IT Morph LLC is the sole legal entity responsible for the PineFixers platform. All references to "PineFixers," "we," "us," or "our" in these Terms refer to IT Morph LLC.
Definitions
- "Platform" refers to the PineFixers website and services
- "Customer" refers to users who post jobs and request HVAC services
- "Provider" refers to HVAC service professionals who offer their services
- "User" refers to both Customers and Providers
- "We," "us," or "our" refers to IT Morph LLC, the legal entity operating PineFixers
Eligibility
You must be at least 18 years old to use our platform. By using PineFixers, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
User Accounts
Account Registration
To use certain features of the platform, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
Provider Verification
Service Providers must submit valid certifications and credentials for verification. We reserve the right to verify credentials and approve or reject Provider applications at our discretion.
Platform Services
For Customers
Customers can:
- Post job requests for HVAC services
- Review proposals from verified Providers
- Accept proposals and hire Providers
- Make payments through our secure payment system
- Leave reviews and ratings for completed services
For Providers
Providers can:
- Browse available jobs in their service area
- Submit proposals to Customers
- Accept jobs and provide services
- Receive payments through Stripe Connect
- Build their profile and receive reviews
SMS Notifications
By opting in to SMS notifications, you agree to receive text messages from PineFixers regarding:
- Job status updates and notifications
- Service provider acceptance confirmations
- Job completion alerts
- Other transactional messages related to your use of the platform
SMS Terms: Message and data rates may apply. Message frequency varies based on your activity. You can opt-out at any time by updating your notification preferences in your profile settings. For help, contact support@pinefixers.com.
Payments and Fees
Payment Methods
Currently, PineFixers operates on a cash basis for all transactions. Customers pay Providers directly in cash upon completion of services.
Online Payments Coming Soon
We are working to introduce online payment processing through Stripe in the near future. When online payments become available, all users will be informed through platform notifications and email updates. This will provide secure and convenient payment options with faster processing, better security, and automated record-keeping.
Refunds and Disputes
Payment disputes should be resolved directly between Customers and Providers. PineFixers may assist in mediation but is not responsible for refunds or dispute resolution.
User Conduct
You agree NOT to:
- Violate any laws or regulations
- Post false, misleading, or fraudulent information
- Impersonate another person or entity
- Harass, abuse, or harm other users
- Attempt to circumvent platform fees or payments
- Use the platform for any unauthorized commercial purposes
- Interfere with or disrupt the platform's operation
- Collect user information without consent
- Upload viruses or malicious code
Provider Responsibilities
Service Providers agree to:
- Maintain valid licenses, certifications, and insurance as required by law
- Provide services in a professional and timely manner
- Comply with all applicable laws and regulations
- Accurately represent their qualifications and experience
- Complete jobs as agreed with Customers
- Maintain their own tools, equipment, and supplies
License Verification Requirement
Providers must have a valid license and be verified by PineFixers before they can accept jobs. This requirement applies to all service types including HVAC, plumbing, electrical works, and any other services offered on the platform. Providers must submit valid proof of licensure and complete the verification process before being eligible to accept job requests. Unverified providers are not permitted to accept or perform any services through the PineFixers platform.
Independent Contractor Status: Providers are independent contractors, not employees of PineFixers. Providers are responsible for their own taxes, insurance, and compliance with local regulations.
Customer Responsibilities
Customers agree to:
- Provide accurate job descriptions and requirements
- Make timely payments for completed services
- Provide safe access to the work location
- Communicate clearly and professionally with Providers
- Leave honest and fair reviews
Intellectual Property
The PineFixers platform, including its design, features, and content, is owned by IT Morph LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
Disclaimers
Platform as Marketplace: PineFixers is a platform that connects Customers with licensed skilled workers (Providers). We do not provide HVAC services directly and are not a service provider.
No Warranties: The platform is provided "as is" without warranties of any kind. We do not guarantee the quality, safety, or legality of services provided by Providers.
Provider Verification: While we verify Provider credentials, we do not guarantee the accuracy of information provided by Providers or the quality of their services.
Limitation of Liability
To the maximum extent permitted by law, IT Morph LLC (operating as PineFixers) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform or services obtained through the platform.
Property Damage and Missing Items Disclaimer
PineFixers is not responsible for any damages to property, personal belongings, or missing items that may occur during or after service delivery by Providers. As a marketplace platform, PineFixers facilitates connections between Customers and Providers but does not directly perform any services. Any claims regarding property damage, loss of items, or similar issues must be resolved directly between the Customer and the Provider. PineFixers does not guarantee the safety, security, or condition of any property or personal items during service provision.
Safety and Criminal Activity Disclaimer
PineFixers is not responsible for any criminal activities, illegal acts, or safety incidents that may occur during or after service interactions between users. If you experience any criminal activity, threats, harassment, or any situation that endangers your safety, you must immediately contact local law enforcement authorities. PineFixers is a marketplace platform and does not provide security services or guarantee the safety of interactions between users. In case of emergency, dial 911 or your local emergency number.
Indemnification
You agree to indemnify and hold harmless IT Morph LLC (operating as PineFixers) from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, violation of these Terms, or violation of any rights of another party.
Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may also terminate your account at any time by contacting us.
Dispute Resolution
Any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Changes to These Terms
By agreeing to these Terms of Service, you acknowledge and agree that IT Morph LLC (operating as PineFixers) may modify these Terms from time to time. We reserve the right to update, change, or replace any part of these Terms at our sole discretion.
We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the platform after changes constitutes acceptance of the modified Terms.
Important: It is your responsibility to review these Terms periodically for any changes. Your continued use of the PineFixers platform after any modifications to these Terms constitutes your acceptance of the updated Terms, including any future changes that may be made.
